These terms are an agreement between you and TapForge Studios (99 Cent Apps LLC) ("we", "us") about the PixelSmith app ("the app"). By downloading or using the app you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the app. Google Play's own terms also apply to downloads and purchases made through Google Play.
We give you a personal, non-exclusive, non-transferable license to install and use the app on devices you own or control, for personal or commercial photo editing, as long as you follow these terms. You may not sell, rent or redistribute the app or the AI models that come with it or that it downloads, use them outside the app, or copy, modify or reverse engineer the app except where the law allows it.
You keep all rights to the photos you edit and the results you create. The app processes them on your device and we receive no rights to them. You are responsible for having the right to edit the photos you use and for how you use the results. Please don't use PixelSmith to infringe other people's rights (for example by removing watermarks or credits from images you don't own), to harass or deceive people (including passing off a retouched or combined photo of someone as unedited to mislead others), or to create unlawful content.
PixelSmith's AI tools (such as AI Enhance, Remove Background, Magic Eraser, Portrait Blur, Retouch and the HD AI tools) run on your device and can make mistakes: an edge may be missed, a fill may look wrong, a face may not be found or a detail may be invented. Review results before you rely on them. Results can differ between devices. Saving a result creates a new image; the app does not change your original photo.
The free version shows ads served by Google. Your choices about ad personalization and consent are described in the Privacy Policy and in Settings › Ad privacy choices where it applies.
Some AI models (HD AI) are optional downloads delivered by Google Play. Whether a download is available can depend on your device, free storage and region. We may update, replace or withdraw models in later versions.
The app includes open-source software and AI models that are licensed to us under their own licenses. Those licenses, listed in Settings › Open-source & AI model licenses, govern those components.
We may update the app and these terms. When we change these terms we will update the date above; if you keep using the app after a change, the new terms apply. We may add, change or remove features.
To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Keep backups of photos that matter to you.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost data or profits, arising from your use of the app. Our total liability for any claim about the app is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits rights you have under consumer laws that can't be limited by agreement.
These terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-law rules, except where the consumer laws of your country give you the right to rely on local law or local courts.
